Lindsay Lohan attacked by waitress

Lindsay Lohan claims she was attacked by a waitress.

The 'Mean Girls' actress - who turns 24 today (02.07.10) - was enjoying a night out at a restaurant when she alleges things got violent with one of the eatery's member's of staff.

She tweeted: "A waitress just hit me - punched me for no reason."

It is not known where Lindsay was dining and who the waitress was.

Although she celebrates her birthday today, Lindsay - who currently has to wear an alcohol-monitoring SCRAM bracelet as part of her probation for a driving under the influence (DUI) arrest - has told friends she won't be having a wild night out because of her current situation.

One pal told gossip website TMZ: "I mean there's not much you can do with a monitoring bracelet and no money."

Lindsay is due in court on Tuesday (06.07.10), where Judge Marsha Revel will determine how well she is adhering to the court-imposed restrictions.

With the alleged assault and no birthday party, it has not been a good few days for Lindsay as it was also revealed this week she is to be sued for over $16,000.

The troubled star has been accused of premeditated fraud by upmarket Los Angeles boutique Tough as Nails, who claim she racked up a bill of $17,060.83 between November 2009 and February 2010, but never paid.

According to the suit - which is to be filed in Los Angeles County Superior Court - Lindsay promised the store owners her business manager would pay the bill, but just $180 of the total was paid off.
