Lawsuit to silence artificial waterfalls

A man has filed a lawsuit to stop the artificial waterfalls and creeks from running near his flat, as he finds them too noisy, reports Guangzhou Daily.

Dai, who lives in a luxury apartment complex in Zhongshan, said the family has to shut all the windows when the water runs. Both his infant daughter and elderly mother have suffered from the noise pollution, he said.

The property management firm adjusted the water-volume in May but the measure failed to satisfy Dai.

No other resident in the complex have complained about the water noise. Keeping the waterfalls and creeks dry would affect the beauty of the complex, the company argued.

Dai pointed out that the other residents were probably not disturbed because their apartments were located away from the waterfalls.

In a test conducted in front of a judge with the Zhongshan Intermediate People's Court, the noise levels from the water running outside Dai's flat were found to border or surpass the State standard. Dai demanded only 1 yuan (12 US cents) in damages as long as the water noise is kept under State norms in future.
