Measures for Management of Recommended Services Suppliers for Participants of World Expo 2010 Shanghai China

Updated: 2009-04-14 18:44 Chapter IV Routine Management Article 17 The Supervisor will enter into an "Agreement of Recommended Services Suppliers" with the Recommended Services Suppliers, and will take effective measures in supervising their service activities. Article 18 The Supervisor is authorized to take routine management upon the Recommended Services Suppliers, establish and maintain a supervision and evaluation system, and periodically publish a performance review report. It shall also give necessary instructions to the Recommended Services Suppliers, helping improve their services. Article 19 As of the effective date of the "Agreement of Recommended Services Suppliers", the Recommended Services Suppliers shall submit a written half-yearly performance report to the Supervisor, with detail description of such information as the number of contracts (between the Recommended Services Suppliers and the Expo participants), service scope of work, contract cost, service team, service performance, feedback from the Expo participants, and improvement measures. Article 20 During the valid period of the "Agreement of Recommended Services Suppliers", the Recommended Services Suppliers shall submit a written report to the Supervisor in case of following matters within 48 hours after the occurrence. 1. Change of company name or address of registration. 2. Change of legal representative. 3. A substantial change of registered capital or big shareholders. 4. Encounter serious business operation or financial problems. 5. Being involved in a big lawsuit or penalty. 6. Issues concerning company separation, merge, cancellation, dissolution or bankrupt. Chapter V Management on Settlement of Disputes Article 21 During service provision, any dispute between the Recommended Services Suppliers and the Expo participants should be resolved through friendly negotiation; the Recommended Services Suppliers shall submit a written report detailing the dispute, in a timely manner, to the Supervisor, who shall then give proper instructions for a sound settlement or mediate a settlement between them. In order to accelerate or ensure the preparation work of the Expo, the Supervisor may ask the Recommended Services Suppliers to temporarily leave aside the dispute and provide relevant services to the Expo participants as required. Article 22 Instructing and mediating effort and process made by the Supervisor for settlement of disputes shall include: 1. Upon receipt of the dispute report from the Recommended Services Suppliers or complaint from the Expo participants, the Supervisor will carry out relevant investigations in a timely manner. 2. For disputes due to reasons of the Recommended Services Suppliers, the Supervisor will give proper instructions to them for correction or improvement, and give a timely feedback to the Expo participants. For disputes inconsistent with the facts or disputes due to misunderstandings, the Supervisor will also give a timely notification to the Expo participants after coordination. 3. Disputes arising during the performance of contract, with no settlement be reached through coordination and mediation made by the Supervisor, should be resolved in accordance with relevant contractual stipulations by the Recommended Services Suppliers and the Expo participants. Article 23 The Recommended Services Suppliers are not allowed to openly release any information concerning the disputes (between the recommended Services Suppliers and the Expo participants) and the settlement, to publicize or assist any third party in publicizing such information in any way, except those activities as required by relevant laws and regulations. Chapter VI Supplementary Articles Article 24 The Bureau of Shanghai World Expo Coordination reserves the right to interpret the Measures for Management, which will come into effect as of its promulgation.
