Xici. net lost the trademark suit to Xici estate

The High People’s Court of Jiangsu Province ruled recently as the final and conclusive judgement that Xici estate did not infringe Xici. net’s trademark right and can continue using “Xici” for its new resident buildings.

Xici.net filed its suit in 2007, claiming that Xici estate misled the consumers by using the name “Xici” which was much better known as an online community. Xici estate, yet found no tort existed as “Xici” had never been registered under the business categories of insurance, finance, currency and real estate.

Hong Yanyan, a lawyer with the Nanjing Hongyan Trademark Agent, deemed that “Xici” did not fall under the provisions for exclusive protection as it wasn’t a nation-wide famous trademark. For Xici estate’s success in prior registration for the category of real estate, the Xici estate understandably won the suit.
