Burberry’s signature check trademark is under threat in China, where the luxury brand faces a ruling which challenges its exclusive rights to use the red, black and tan design. China’s trademark office revoked Burberry’s trademark of the above design after a legal challenge by local fashion house Polo Santa Roberta (PSR), which also wants to use the plaid image, known as the “Haymarket Check” in its bags and accessories. It is reported that the decision came after lawyers for PSR argued that Burberry was monopolising part of Scotland’s cultural heritage. PSR launched the appeal on the basis that Burberry had not used the pattern for three years, which in China is grounds to question a trademark’s ownership. Burberry, however, insists that the trademark is still intact and has launched an appeal.
