Circumstances where the tortfeasor assumes tort liability

According to the provisions of Tort Liability Law, there are three kinds of circumstances where the tortfeasor assumes tort liability: First, any person who infringes another person’s civil rights and interests out of his own fault shall bear tort liability. Second, any person who is at fault as construed according to provisions of laws and cannot prove otherwise shall bear tort liability. Third, any person who infringes another person’s civil rights and interests, whether at fault or not, as provided by law that he shall bear tort liability, shall be subject to such legal provisions and bear tort liability.
