Procuratorates raise daily State compensation standard for personal freedom violations

China's procuratorial organs have raised the daily State compensation standard for violations of personal freedom from 475.52 yuan ($69.93) to 495.94 yuan ($72.93), the Supreme People's Procuratorate has said.

The new standard, which took effect on Monday, applies to State compensation cases in which procuratorial organs are liable for compensation, according to a recent notice issued by the SPP.

An official with the SPP's accusations and complaints procuratorial department said the National Bureau of Statistics announced on May 15 that the average annual salary of employees in urban non-private entities nationwide reached 129,441 yuan in 2025.

Based on the formula for calculating average daily wages provided by the Ministry of Human Resources and Social Security, the new daily compensation standard is 495.94 yuan, the official said.

The SPP issued a similar notice in May 2025, requiring procuratorial organs at all levels to calculate compensation for violations of citizens' personal freedom at 475.52 yuan per day when making State compensation decisions.

Under the State Compensation Law and a judicial interpretation on criminal compensation cases issued by the Supreme People's Court and the SPP, procuratorial organs at all levels must calculate compensation for violations of citizens' personal freedom at 495.94 yuan per day when making State compensation decisions from May 18 onward.
