The patent rights refer to the exclusive rights of the use of the inventions and innovations owned by the patent applicants (units or individuals), who are granted to, within a legal term limit, enjoy the rights by the administrative government (or region) department in charge of patents (in China, it is the “State Intellectual Property Office”), that is, no unit or individual is allowed to, without the permission of the patent owners, use patents during the implementing period. There are three kinds of patents, namely, the invention patent, the utility model patent and the design patent in China.
